PLEASE READ THESE TERMS OF SERVICE (“Agreement” or “Terms”) CAREFULLY BEFORE USING THE SMART CLEANER MOBILE APPLICATION (“App” or “Smart Cleaner”). THIS AGREEMENT GOVERNS YOUR USE OF THE SMART CLEANER APPLICATION, ANY SERVICES PROVIDED THROUGH THE APP, AND ANY RELATED CONTENT.
By downloading, installing, using, or retaining Smart Cleaner, you agree that you have read, understood, and are legally bound by these Terms. If you do not agree with any part of this Agreement, you must immediately stop using and delete the App.
1. License Grant
1.1 Subject to your compliance with these Terms, the provider of Smart Cleaner (the “Company”, “we”, “us”, or “our”) grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial use.
1.2 You may make one backup copy of the App in object code form for archival purposes only.
1.3 You may not reverse engineer, decompile, disassemble, or attempt to discover the source code of the App, except to the extent that such activity is expressly permitted by applicable law.
1.4 Any transfer, assignment, sublicense, or other distribution of the App or rights granted under this Agreement is prohibited without our explicit prior written consent.
2. Restrictions
You agree not to:
•Use the App for any unlawful, unauthorized, or harmful purposes.
•Modify, adapt, translate, or create derivative works based on the App.
•Circumvent or disable any security or technological features of the App.
•Remove, alter, or obscure any proprietary notices in the App.
3. Updates & Support
We may provide updates, upgrades, patches, or new versions of the App at our discretion. Any such update may be automatically delivered and installed without providing specific notice. Support services, if any, are provided at our discretion and may be subject to additional terms.
4. User Content
Smart Cleaner does not require users to upload personal content to our servers. Any photos, files, or data processed by the App are handled locally on your device unless otherwise specified. You are responsible for maintaining backups of all your data.
5. Third-Party Services
The App may include links to third-party websites, services, or integrations. Your use of third-party services is governed by the terms and privacy policies of those third parties. We are not responsible for such third-party content or conduct.
6. Privacy Policy
Your use of Smart Cleaner is also pgoverned by our Privacy Policy, which explains how we collect, use, and protect information. By using the App, you acknowledge that you have read and agree to the Privacy Policy.
7. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMART CLEANER IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY OF RESULTS.
We do not guarantee:
•That the App will be error-free or uninterrupted.
•That defects will be corrected.
•That the App is free of viruses, malware, or harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING THE APP.
9. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of:
•Your use of the App,
•Your violation of these Terms,
•Your violation of third-party rights.
10. Termination
We may terminate this Agreement at any time without notice if you breach any provision of these Terms. Upon termination:
•Your license to use the App will expire,
•You must cease all use of the App,
•And you must delete all copies of the App from your devices.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is registered, without regard to conflict of law principles.
12. Changes to These Terms
We may revise these Terms of Service from time to time. Updated terms will be posted in the App and/or on our website. Your continued use of Smart Cleaner after revisions constitutes your acceptance of the updated Terms.
